What Is the EU Digital Markets Act (DMA)?

The Digital Markets Act (DMA) — formally Regulation (EU) 2022/1925 of the European Parliament and of the Council — is a landmark piece of EU legislation that came into force on 1 November 2022 and became fully applicable on 6 March 2024.

The DMA aims to ensure fair, open, and contestable digital markets across the European Union. It creates obligations for certain large digital platform operators — designated as "gatekeepers" — to prevent them from using their dominant market position to unfairly restrict competition, limit user choice, or exploit businesses and consumers who depend on their platforms.

The DMA is enforced by the European Commission. In Ireland, the Competition and Consumer Protection Commission (CCPC) also plays a role in digital market regulation alongside the EU-level enforcement framework.

Does the DMA Apply to Best Irish IPTV?

The DMA's primary obligations apply specifically to companies designated as "gatekeepers" — large digital platform operators that meet certain quantitative thresholds set out in Article 3 of the Regulation. These thresholds relate to:

  • An annual turnover of €7.5 billion or more in the EEA in the last three financial years, or a market capitalisation of at least €75 billion
  • Providing a "core platform service" to at least 45 million monthly active end users in the EU and at least 10,000 yearly active business users in the EU
Best Irish IPTV — Not a Designated Gatekeeper
Best Irish IPTV does not meet the thresholds required for designation as a "gatekeeper" under the DMA. We are a small Irish IPTV subscription provider, not a large digital platform operator. Accordingly, the specific gatekeeper obligations under Articles 5–7 of the DMA do not directly apply to us as a primary obligation.

However, Best Irish IPTV operates within an ecosystem that includes services provided by designated gatekeepers — including app stores (Apple App Store, Google Play Store), operating systems (Android, iOS), and communication platforms (WhatsApp/Meta). As a business user of these platforms, we benefit from the DMA's protections for business users and are committed to principles that align with the DMA's broader goals of fairness and openness.

We publish this DMA Compliance Statement in the spirit of transparency and to inform our users of their rights under the broader EU digital regulatory framework, including protections afforded by the DMA to consumers and business users interacting with gatekeeper platforms.

Our DMA-Aligned Commitments

Although we are not a designated gatekeeper, Best Irish IPTV voluntarily commits to principles that align with the DMA's core objectives of fairness, transparency, and user empowerment. These commitments reflect our values as an Irish IPTV provider since 2012:

Fair & Transparent Pricing

In alignment with the DMA's goals of fair and transparent commercial practices, Best Irish IPTV commits to the following pricing principles:

  • No hidden charges: The price shown on our Subscription page is the complete price. There are no activation fees, setup fees, or additional charges for included content.
  • No drip pricing: We do not show a low base price and add mandatory charges during the checkout process. Our prices are complete and final from the outset.
  • No discriminatory pricing: We charge the same price for the same plan to all customers, regardless of their device, operating system, or geographic location within our service area.
  • No auto-renewal without consent: We do not automatically charge customers at the end of a subscription period. Renewal requires an active choice by the customer.
  • Price parity: We do not impose restrictions that would prevent customers from accessing our service at a lower price through other channels.

The DMA's pricing transparency obligations on gatekeepers (Article 5(3)) are designed to protect business users — including IPTV subscription providers like us — from being forced to offer less favourable prices on their own channels than on gatekeeper platforms. Best Irish IPTV sells only through its own website (bestirishiptv.shop) and WhatsApp channel, ensuring direct pricing control.

Interoperability & Device Choice

The DMA requires designated gatekeepers to ensure interoperability of their services with third-party products and services. While this specific obligation applies to gatekeepers, Best Irish IPTV embraces interoperability as a core service principle:

  • Our IPTV service uses open, industry-standard protocols — Xtream Codes API and M3U playlist format — that are compatible with any IPTV player application.
  • We do not require customers to use a specific proprietary application. Any compatible IPTV player can be used with our credentials.
  • Our service works across all major operating systems and device types: Android, iOS, Windows, macOS, and smart TV platforms including Samsung Tizen and LG webOS.
  • We do not create artificial technical barriers that would restrict access to our service based on device or platform choice.
  • If a third-party application used to access our service stops working or changes, we support our customers in finding alternative compatible applications at no cost.

Data Practices & DMA Alignment

The DMA includes significant provisions around data practices by gatekeepers, including restrictions on combining personal data from different services without explicit consent and requirements to enable data portability. Best Irish IPTV aligns with these principles:

Data Minimisation

No Gatekeeping Practices

Best Irish IPTV does not engage in the types of anti-competitive gatekeeping practices that the DMA is designed to prevent. Specifically:

  • No self-preferencing: We do not unfairly favour our own products or services in any ranking, search, or recommendation system. We recommend third-party IPTV applications that work best for our customers, regardless of any commercial relationship.
  • No tying: We do not bundle our IPTV subscription with mandatory purchases of other products or services. Our subscription stands alone.
  • No most-favoured-nation clauses: We do not impose restrictions on our customers' ability to obtain our service or comparable services from other providers at any price they choose.
  • No anti-steering: We do not prevent customers from accessing information about, or switching to, competing IPTV services. Customers are free to compare providers and choose the service that best meets their needs.
  • No barriers to switching: If you decide to switch to a different IPTV provider, there are no penalties, fees, or technical barriers imposed by Best Irish IPTV. Your subscription simply expires at the end of the purchased period.
